Who Pays for the Fence Between Neighbours?
In Victoria, the dividing fence between two properties is generally treated as jointly owned, and the cost of a "sufficient dividing fence" is usually shared 50/50 between neighbours under the Fences Act.
Before any work starts, you should give your neighbour written notice (a "Fencing Notice") setting out the proposal, type, height, materials, who's doing the work, and the cost. If you can't agree, the Magistrates' Court can decide.
We routinely help homeowners through the conversation: we'll prepare a clear quote you can show the neighbour, suggest a "sufficient" middle-ground option, and answer questions about dividing fence rules.
- We prepare a quote you can share with your neighbour
- We can install regardless of whether the neighbour pays in full
- We follow Victorian fencing rules & can advise on basic notice requirements
Note: this is general info, not legal advice. For disputes, contact the Dispute Settlement Centre of Victoria.
What Locals Say
Reviews from homeowners and businesses across Melbourne's west.
"Got three quotes for a Colorbond fence in Tarneit. They weren't the cheapest but the quote was the clearest. Showed up on the day, finished in two, cleaned up properly. Fence is dead straight."
"Pool fence inspection had failed twice before we called these guys. They redid the spigots, sorted the latch height, and we passed first go. Great communication the whole way through."
"Storm took out 18m of paling. They were measuring within 48 hours and installed the following week. Helped me sort the cost-share with my neighbour too."
Common Fencing Questions
How long does a new fence take to install?
Most domestic fences in Melbourne's west are installed in 1β2 days once we're on site. Bigger jobs, sloped blocks, or installs with a lot of removal can take longer. We'll give you a realistic timeframe in your written quote.
Do I need council approval for a fence?
For standard residential fences up to 2m, you usually don't need a planning permit, but front-fence height limits and heritage overlays vary by council. In Wyndham, Hobsons Bay, Melton and Brimbank we can advise based on your address, and if a permit is needed, we help with the paperwork.
Who pays, me or my neighbour?
In Victoria, the cost of a "sufficient dividing fence" is generally split 50/50 between neighbours under the Fences Act. We can prepare a quote you can show your neighbour and we can also do the install whether they pay their half upfront or not.
Is Colorbond better than timber paling?
Colorbond is lower maintenance, doesn't rot, and lasts 20+ years. Timber is cheaper upfront, has a more traditional look, and is easier to repair panel-by-panel. Both are great. Pick based on look, budget and how long you'll be in the home.
Can you remove the old fence?
Yes, and this is included as a line item in your quote. We dispose of the old materials properly. If asbestos is suspected (older sheet fences), we use a licensed removalist.
Do you install gates?
Yes, pedestrian, double swing, and automatic sliding gates in steel, aluminium and timber. We can also retrofit a gate into an existing fence run.
Do you service my suburb?
If you're in Wyndham, Hobsons Bay, Brimbank, Melton or surrounds, almost certainly yes. Check the Service Areas list above, or just call us.
What payment terms do you offer?
Typically a deposit on acceptance, with the balance due on completion. Full terms are on your written quote. We accept bank transfer and most cards.
